Terms of use
1. Who we are and what we offer
These terms govern the use of Ensemblum (the "Service"), run by Ensemblum ("we"). The Service is an online tool that lets orchestras and other music organisations ("Orchestras") post substitution requests, and professional musicians ("Musicians") receive and answer them and build a profile based on verified engagements.
2. Role of the Service
The Service puts the parties in contact and suggests candidates automatically, explaining the criteria. The final choice is always the Orchestra's.
We are not a party to relationships between Orchestras and Musicians: we are not an employer, client, employment agency or payment intermediary. Type of contract, fee, social security, taxes, insurance, health and safety and any other legal duty rest solely with the parties.
We do not guarantee that a request will be filled, that a Musician is available or suitable, or that fees will be paid.
3. Accounts
You must be at least 18 and provide true information. One account per person; an Orchestra account may only be opened by someone authorised to represent the organisation.
You log in through a link sent by email: you are responsible for the security of your mailbox and of any API keys you create.
4. Free of charge and future changes
During launch the Service is free. Any paid plans for Orchestras will be announced at least 30 days in advance and will apply only after your express acceptance; there will never be automatic charges without consent.
5. Rules for Orchestras
Post only real requests with correct information on dates, venue, fee and expenses; update or cancel the request if it changes.
Honour commitments to confirmed Musicians and comply with labour, equal-treatment and anti-discrimination law.
Use Musicians' data only for the production for which you receive it.
6. Rules for Musicians
Answer only if you are really available. If after confirmation you can no longer take part, free the seat as soon as possible with the dedicated function and give the reason.
Name as backups only colleagues who agree to be contacted.
Colleagues' details visible on the rooms and rides board may only be used to organise that production.
6a. Events on request (clients and ensembles)
Individuals, companies and organisations ("Clients") can describe an event and receive quotes from orchestras and groups ("Ensembles"). The Ensemble sets price, deposit and conditions; contract, payment, invoices, permits and performing rights concern only Client and Ensemble.
The Service is not a party to the agreement, does not collect payments and does not guarantee the performance. The Ensemble's cost sheet is a private calculation tool and is never shown to the Client.
A quote sent is an offer: the Client accepts it with the dedicated button. Whoever cancels a booking must give a reason; the financial consequences (deposit, penalties) are those agreed between the parties.
7. Ratings
Ratings are possible only after a verified engagement and must be honest and based on real experience. They become public only after at least 3 ratings; the Musician may reply.
We may hide ratings that are manifestly false, offensive or unlawful, giving reasons.
8. Prohibited content and conduct
You may not publish unlawful, offensive, discriminatory or misleading content; use the Service for spam, advertising or data harvesting; circumvent security measures; create fake accounts; use others' data for other purposes.
You keep the rights to your content and grant us the free, non-exclusive licence needed to display it within the Service.
9. Notices and moderation
Anyone can report content or conduct with the "Report" form or by writing to ensemblum.team@gmail.com. We review notices diligently and send a reasoned decision to the reporter and, where possible, to the person concerned.
For breaches we may hide content, suspend or close accounts, stating the reason. You can contest the decision by replying to the email or writing to ensemblum.team@gmail.com.
10. AI assistants and API
You can create personal keys to let an assistant act on your behalf. Actions taken with your keys are yours: check what the assistant does and revoke keys you no longer need. Usage limits apply.
11. Availability and liability
The Service is provided "as is", with care but without a guarantee of uninterrupted operation. We may change or discontinue it.
To the extent permitted by law we are not liable for relationships between the parties or for indirect damage. Liability for intent or gross negligence and mandatory consumer protections remain unaffected.
12. Termination and deletion
You can delete your account at any time from the Account page; data is erased as described in the privacy notice. We may close the Service with reasonable notice.
13. Changes to these terms
We may update these terms. Material changes will be shown at your next login and require new acceptance.
14. Governing law
Italian law applies. If you act as a consumer, the jurisdiction of your courts and the mandatory rules of your country remain unaffected. Version of 2026-11-01. In case of differences between translations the Italian text prevails.
